According to the Bureau of Justice Statistics, approximately 50 percent of medical malpractice trials in 75 of the largest counties in the United States in 2001 were conducted against surgeons. Using data from the National Practitioner Data Bank, the American College of Surgeons reported that the most common surgical errors stated in medical malpractice claims and lawsuits were leaving a foreign object in the patient’s body, operating on the wrong body part, improper surgical performance, improper management, engaging in an unnecessary procedure, failing to get informed consent, and failing to recognize a complication arising from surgery.
The U.S. National Library of Medicine reports in an abstract on technical surgical errors that 49 percent of technical errors surveyed from randomly sampled medical malpractice claims resulted in permanent disability for the patient. 65 percent of such errors were based on manual error while 9 percent were errors in judgment. 26 percent of the errors were a combination of manual and judgmental mistakes. The report indicated that most technical errors occur in routine operations done by experienced surgeons under conditions involving complex circumstances.
