According to the Bureau of Justice Statistics, approximately 50 percent of medical malpractice trials in 75 of the largest counties in the United States in 2001 were conducted against surgeons. The U.S. National Library of Medicine reports in an abstract on technical surgical errors that 49 percent of technical errors surveyed from randomly sampled medical malpractice claims resulted in permanent disability for the patient. 65 percent of such errors were based on manual error while 9 percent were errors in judgment. 26 percent of the errors were a combination of manual and judgmental mistakes. The report indicated that most technical errors occur in routine operations done by experienced surgeons under conditions involving complex circumstances.
